LIVERMORE — The Planning Board will hold a public hearing Wednesday on proposed amendments to the Site Plan Review Ordinance that include noise, lighting, signs and adult entertainment for businesses.

A revised floodplain management ordinance will also be reviewed at 7 p.m. May 15 in the gymnasium of the Livermore Elementary School.

The floodplain ordinance updates the town’s current statute to comply with the Federal Emergency Management Agency’s regulations.

Amendments proposed to the site plan document went before voters last year as one package. Voters rejected them in June 2012 and said they wanted to vote on each amendment separately so they could pick and choose what they agreed with, administrative assistant Kurt Schaub said Friday. He is also a Planning Board member.

This year, each amendment will be voted on in separate articles at the annual town meeting Wednesday, June 12.

If voters approve the changes, the amendments would only apply to new applications, he said.

The first four amendments are considered to be “good neighbor provisions.”

Noise has been discussed in previous years, including when an all-terrain park was approved. The town had no ordinances to regulate noise.

According to the proposal, the licensed business would not be able to allow on any premises the “making, creation, or maintenance of excessive, or unnecessary, or unnatural or unusually loud noises, which disturbs, annoys, injures or prejudices, or endangers the comfort, repose, health, peace, or safety of individuals of ordinary sensibilities or the public in general, or the property rights of others.”

Other amendments address exterior lighting, buffering of adjacent uses and storage of materials.

Another amendment proposed for business signs would require freestanding signs to blend harmoniously with the character of the area where the business is located. Provisions also outline how the signs would need to be set up.

It also addresses changeable message signs. Among the criteria for those would be that they cannot change more frequently than five seconds. The state law is two minutes.

“Without this provision, changeable signs would not be allowed,” Schaub said.

The amendment proposed to cover adult entertainment is 12 pages.

The purpose of the section is to regulate adult entertainment establishments and related activities to promote the health, safety and general welfare of the citizens of the town. It also establishes reasonable and uniform regulations, according to the section.

It sets criteria and standards for businesses that are not licensed to serve alcohol. The town previously adopted a special amusement ordinance that covers licensed establishments. There is currently no ordinance that covers unlicensed establishments, Schaub said.
