BANGOR — The 20-year-old charged with murder in the death of 15-year-old Nichole Cable of Glenburn made his first court appearance Wednesday at the Penobscot Judicial Center in Bangor.
Kyle Dube of Orono did not enter a plea to the charge of intentional or knowing murder because he has not yet been indicted by a grand jury.
Dressed in jeans and a white T-shirt, Dube answered, “yes,” when asked if he understood the charge and why he was in court.
Superior Court Justice William Anderson informed him of the charge and formally appointed Bangor attorney Stephen Smith to represent Dube.
Anderson ordered that Dube be held without bail until a hearing can be scheduled this summer to determine if he is eligible to be released.
A trial date was not set.
Anderson agreed to a defense request to impound the affidavit while he considers whether to release it publicly.
He most likely will be indicted by the Penobscot County grand jury next week or in June.
The hearing began nearly an hour late.
Several friends of Cable were at the court wearing bright yellow T-shirts with hand-written messages about her.
A body believed to be Cable ’s was discovered late Monday in a wooded area of Old Town. Results of an autopsy that would state when and how Cable died were to be released Wednesday afternoon, Maine State Police said Tuesday at a press conference that announced Dube’s arrest.
The girl disappeared from her home the night of May 12 and was reported missing the next morning. More than 500 people turned out Sunday to help search for clues in the teen’s disappearance.
If convicted of murder, Dube faces between 25 years and life in prison.
Dube began serving a 90-day sentence at the county jail May 17 on one count each of driving to endanger and criminal speeding.
The charges stemmed from a high-speed chase with police last June. Dube pleaded guilty to the Class E crimes May 10. In a plea agreement with the Penobscot County district attorney’s office, a felony charge of eluding a police officer was dismissed.
