LEWISTON — The Androscoggin County Chamber of Commerce will hold its next LA Law advisory workshop from noon to 1:30 p.m. Tuesday, Jan. 26, at the chamber, 415 Lisbon St. The topic is “Advising Employers on I-9 Compliance and Audits” with presenter Michael Malloy.

The Form I-9 is two pages with a 70-page instruction manual. The employer must physically inspect documents produced by the worker, but can be liable for discrimination claims for requesting particular documents or asking the wrong questions. Employers can be fined by Immigration and Customs Enforcement for not filling out a form, and may be sued by the Office of Special Counsel if they request too much documentation based on an employee’s national origin. 

Topics for discussion could include:

• I-9 completion requirements — what employers must ask for, and what they can’t ask for;

• Employer record-keeping requirements and best practices;

• Interpreting immigration documents;

• Using human resources software — advantages and risks;

• E-Verify — mandatory enrollment, and whether to opt in;

• State law trends in employee verification;

• Responding to an ICE audit.

Malloy practices corporate and real estate law at Brann & Isaacson in Lewiston. He is also a member of the American Immigration Lawyers Association and has a background in business immigration law. He has successfully helped clients navigate Homeland Security I-9 audits and also assists clients with internal audits.
